Interested in becoming Legal Counsel – Privacy, Consumer Finance & Operations at Aaron’s?  The Legal Counsel – Privacy, Consumer Finance & Operations, will provide privacy, consumer finance, and general operations counsel to the Company’s various business units and field operating divisions.  This position has primary responsibility for ensuring compliance with all applicable privacy and data security laws that impact the Company as well as guidance to the Compliance Department, Information Security Department and other functional groups managing privacy and security initiatives for the Company.  This position will also have some general counseling responsibilities and serve as lead counsel for certain operating divisions within the field, including advice on customer disputes, litigation, real estate matters, contracting and other general legal guidance for the field operations.

Duties

  • Effectively communicate privacy, consumer finance, and data security legal guidance to all Company departments and senior management.
  • Provide legal counsel to store operations and field level management.
  • Conduct complex legal research and serve as a resource for privacy, security, and consumer finance issues, including but not limited to privacy laws, HIPAA, CAN-SPAM Act, Red Flags, state privacy and state data breach laws, etc.
  • Manage privacy and data security related investigations, participate in annual risk assessments, and to help develop a work plans to address identified risks, including auditing and monitoring activities.
  • Initiate, facilitate and promote activities to foster privacy awareness.
  • Oversee policies, procedures, vendor contracts, and systems monitoring to ensure compliance with privacy and security requirements.
  • Collaborate in addressing and resolving all privacy and security incidents, implementing preventive safeguards for future best practices.
  • Together with other members of the Legal Department and with other functional departments, manage compliance with all applicable state and federal laws, rules and regulations relating to consumer protection including the Telephone Consumer Protection Act, the Fair Credit Reporting Act and Fair Debt Collection Practices Act, and state collections laws.

Position Requirements

  • Juris Doctor from accredited law school and 6-10 years of experience in a law firm or corporate legal department with experience in privacy, data security, and consumer finance.

  • Some litigation experience preferred.

  • Licensed to practice law in a US state, preferably Georgia.

  • Experience handling and resolving corporate regulatory and privacy incidents and issues.

  • Ability to effectively present information to senior management.

  • Ability to respond to inquiries from regulatory agencies, customers and the business community.

  • Ability to handle multiple projects with critical deadlines.

  • Ability to identify creative solutions to liability exposures in the context of a customer-facing business.

  • Ability and experience in implementation and drafting of policies and procedures.

  • Ability to build relationships, openly share knowledge, and effectively collaborate with business units, other in-house attorneys, and outside counsel.
